UK Man Cashes in With Spam Lawsuits

moneyA 38-year old UK man successfully sued a cookware company for spamming him and won a $1200 judgement. Steve Higgins claimed he had little choice because the company ignored his opt-out requests.

Mr Higgins, a businessman from Northampton, said: ‘The majority of the emails I was receiving I had never opted in to get. I attempted to unsubscribe, but to no avail.  ‘So I sent out letters directly asking them to stop. I didn’t want them. I pleaded with them. A number of companies continued to send them despite the letter, so I started taking action in the small claims court. When I have requested them to stop and they ignore those requests it is really disappointing and frustrating. Even if you have inadvertently signed up to email lists by forgetting to tick a box they should respect your wishes when you ask to unsubscribe.’

A few months ago Higgins won an additional $1500 after successfully suing a payment protection company and says he plans to file spam lawsuits against at least 9 other companies including Capitol One and Halifax Bank. His lawsuits are claiming violations of the Privacy and Electronic Communications Regulations 2003, their version of the US CAN-SPAM Act. He’s encouraging anyone else fed up with spam to file lawsuits of their own. The cookware company, Kent-based Jean Patrique, ignored the court correspondence and never bothered to show up. As of yet they’ve had no comment on the matter either.

The way to go! Hit them when it hurts most – i.e. sue them and make them pay – and they will learn to remove users from their spam lists. Kudos to the guy for the initiative and I hope there will be more to follow.

A lawsuit is always a waste of time and money, but then again, it’s more than a battle of money or resources. It’s a matter of principle, a matter of justice. If these are things that you value, then definitely suing those spammers is worth every penny and second that you spend.

These Mr. Higgins guy is simply amazing! That’s the spirit! We should all emulate him. He is not afraid to go head-to-head with the bigwigs of technology and business. I do not know what I would do if I were in his shoes, but I am sure I will definitely not take things sitting down!…This serves as a warning to spammers: not everyone will be willing to turn a blind eye on you! Some will fight back and win in style! This also signals a new page in the anti-spam story; people are now doing their share of the fight.
